What We’re Looking For:

We are a newly formed (to be) employer-side law firm seeking a passionate, driven, and detail-oriented Attorney with a commitment to excellence and getting results to lead our team of advocate(s).

Our culture is a blend of start up meets boutique meets lawyering with an EQ. We’re not looking to build an outdated law firm, meet billable hour requirements or operate from a place of litigious obsession.

The mission of our firm is to guide and counsel small and medium businesses in employment related matters on a predominantly transactional basis (however some litigation environments are contemplated). As such, there may be a path to litigation work but the goal and theme is guidance, counsel, documentation, and a collaborative approach to employer employee engagement, and relationship.

The ideal candidate will have three to seven years of experience, have a strong background in California wage and hour laws, as well as expertise in FEHA claims, wrongful termination, and whistle-blowing retaliation claims. This position will play a major role in the transaction and potential litigation of employment-related claims before federal and state courts and arbitrations.

The ideal candidate will have worked with small and medium sized businesses and have experience guiding and counseling them on employment related matters.

Compensation commensurate with experience + bonus opportunities. Actual salary offers may vary based on a number of factors including but not limited to training, skill sets, education, licensure and certifications, practice area, market data, internal equity and experience. Duties and Responsibilities:

Responsibilities include transactional, litigation, and working on matters regarding EDD, employee/contractor designation (agreements, opinions, DFEH, FEHA, FMLA, ADA, discrimination, harassment, retaliation, wrongful discharge, and violation of wage and hour law matters.

Experience taking depositions, arguing motions, handling arbitrations, and preparing cases for trial is required.

Completing employee handbooks, reviewing existing books, opining on employee vs contractor arrangements and agreements, first drafts of litigation documents such as responses to administrative discrimination charges, court documents, and other filings and correspondence which put forward relevant facts in a persuasive and compelling manner.

Knowledgeable and experienced in PAGA matters.

Defending claims at mediation/arbitration and trial on behalf of employers with claims made for disability discrimination, unpaid wages and constructive discharge. Resolving cases for companies accused of sexual harassment.

Knowledgeable in employee vs contractor matters, agreements, and classification.

EDD compliance, investigations and representation;

Employee Handbook creation, & annual reports/updates;

Review of existing employee handbooks;

Can provide ongoing training to managers, supervisors, and entire entire human resources department to prevent liability for costly mistakes or oversight;

Sexual harassment;

Can create a harassment, discrimination, and retaliation prevention policy that includes a complaint procedure;

Strong written advocacy skills are required.

Attend depositions; draft meet and confer letters to opposing counsel regarding discovery issues, dispositive motions and trial preparation.

Perform in-depth legal research.

Communicate with outside parties such as attorneys, employers, law enforcement agents, administrative agencies, etc. as needed.

Collaboration with other attorneys and support staff as needed

Maintain effective communication with clients, providing updates on case developments as needed.

Managing all aspects of cases, ensuring all deadlines are met, staying organized and multi-tasking to achieve priorities in a fast-paced environment.

Job Requirements:

Education and Licensing: JD Required

Experience: Minimum 3 years relevant legal experience, including substantial experience litigating and managing complex cases. Prior experience in wrongful termination, discrimination is strongly preferred.

Expertise in Employment Law

Litigation Skills: including experience with all stages of the litigation process from pre-litigation investigation through mediation, trial and appeals, are essential. This includes drafting pleadings, motions and briefs, conducting depositions and arguing in court (when needed).

Communication and Advocacy: excellent oral and written communication skills are essential for effectively representing clients, negotiating settlements, and presenting complex legal arguments.

Able to work effectively independently or within a team
